Terms of Service for Canine Pooper Troopers: Dog Waste Removal**
Effective Date: 07 NOV. 2024
Last Updated: 07 NOV 2024
These Terms of Service (“Agreement”) govern the relationship between you, the customer (“Client”), and Canine Pooper Scooper, a dog waste removal service provider (“Service Provider,” “We,” “Us,” or “Our”). By using our services, you agree to the following terms and conditions.
1. Payment Method
We accept all major credit cards for payment. Payment is required in advance for all scheduled services. All payments are securely processed through a third-party payment processor.
2. Billing Cycle
Monthly Billing: Our services are billed on a monthly basis. Billing occurs on the 1st of each month, and payment is due before services are provided for the upcoming month. By signing up for our services, you authorize us to charge your credit card on the 1st of each month.
Initial or One-Time Cleanups: For initial or one-time dog waste removal services, payment is due upon completion of the job. If a cleanup is performed outside of a regular monthly service, full payment is required immediately following the service.
3. Client Responsibilities
As the Client, you agree to:
Safe Access to Property: You are responsible for ensuring that safe access to your yard is available for our staff. This includes making sure gates are unlocked, fences are intact, and there are no obstacles preventing access to the areas to be cleaned. If we are unable to clean due to access issues, you will still be charged for the scheduled service.
Notification of Changes: You must promptly notify us of any changes in the number of pets at your residence or any other changes that may affect the scope of the service. Failure to notify us may result in inaccurate billing.
Prompt Payment: You are responsible for ensuring that all payments are made in a timely manner. Failure to pay on time may result in service interruptions or termination of service.
4. Inclement Weather and Scheduling
Weather-Related Delays: In the event of inclement weather (e.g., heavy rain, snow, or other hazardous conditions), we may be unable to perform the scheduled service. If this occurs, we will make every effort to reschedule the cleanup as soon as possible once conditions improve.
No Liability for Weather-Related Delay: We are not liable for any damages or failure to provide service due to weather conditions or other external factors beyond our control.
5. Vacation or Temporary Service Pauses
– If your pet(s) will not be using the yard for a period of time (such as during a vacation or due to illness), and you do not wish to be charged for unnecessary visits, you must notify us in advance to pause or reschedule the service. Failure to notify us may result in billing for the scheduled service, regardless of whether or not the service is required.
6. Liability Limitations
No Liability for Property Damage: We assume no responsibility for any damages to your property, including but not limited to your yard, gates, fences, pets, or any other property during the course of our services. While we make every effort to avoid damage, you acknowledge that accidents can happen, and you agree to release us from any liability related to property damage.
Indemnification: You agree to indemnify, defend, and hold harmless Canine Pooper Scooper, its employees, agents, and contractors from and against any claims, damages, losses, and expenses arising from your failure to meet the responsibilities outlined in this Agreement.
7. Fees and Promotions
Fee Changes: Fees for services, as well as any promotions or discounts, are subject to change at any time. In the event of a fee change or modification of promotions, we will notify you at least 14 days prior to implementing any new charges. If you do not agree with the new fees, you may terminate the service as outlined below.
8. Termination of Service
Either party may terminate this Agreement at any time by providing written notice to the other party. If you wish to cancel service, please notify us via email or in writing at least 7 days prior to your next scheduled service date.
Outstanding Balances: In the event of termination, any outstanding balances are due within 15 days. Failure to settle unpaid balances within this period may result in the assessment of late fees or referral to a collection agency.
9. Agreement to Terms
By initiating service with Canine Pooper Scooper you acknowledge that you have read, understood, and agreed to these Terms of Service. These terms constitute a legally binding contract between you and Canine Pooper Scooper. If you do not agree to these terms, please do not use our services.
